Information from Food-Ordering Users

Sign-Up Information: When you register to place orders through our Platform, we collect details like your name, email address, phone number, industry, and login credentials. Order Information: When you place an order, you provide us with details such as the food provider, order items, dietary preferences, delivery time, location, recipient name, and any additional instructions. We also collect payment details, which are securely processed by a third-party payment processor. We do not store full payment information on our servers. User Content: You may choose to submit or share content through our Platform, such as reviews, ratings, photos, or feedback. This content may be visible to other users of our Platform. Communications: If you reach out to us, we may receive details such as your name, email address, phone number, and the content of your inquiry. This could involve questions or concerns regarding your orders, providers, or general issues.

Information from Food Providers

Business and Contact Information: If you are a food provider seeking to join our Platform, we may collect your business details, such as business name, location(s), contact information, website URL, and any other details you provide.

Information from Organizations

Business Information: If you represent an organization interested in facilitating employee or customer orders through our Platform, we collect your contact information, your organization's details, and any other relevant information you provide.

Other Information

In addition to the types mentioned, we gather any additional information that users of our Platform provide.

Information Collected Automatically

We also collect certain information automatically as you interact with our Platform. Usage Data: We track and analyze how you use our Platform, including the times you access it, features you use, pages visited, and the browser or device you use. This includes details of your transactions, such as services requested and amounts charged. Device Data: We collect information about the device you use to access our Platform, including IP address, hardware details, operating system, language preferences, device identifiers, and mobile network details. Location Information: We collect general location data, such as the city and state based on your IP address, to improve content relevance and analyze delivery events. With your consent, we may collect more precise location data for tailored services, promotional offers, and content. You can disable geolocation tracking on your device at any time. Cookies and Tracking Technologies: We use cookies and similar technologies to collect data about how you interact with our Platform. Social Log-Ins and Network Connections: If you access our Platform through a third-party service (like social networks), we may gather certain data from your social profile, such as name, profile picture, and preferences, depending on your privacy settings. Other Third Parties: We may receive additional information from partners, marketers, and data aggregators to enhance the data we collect directly from you. If you are an employee of a food provider, or your employer uses Lilac to manage food orders for its staff or customers, your employer may provide us with information about you. Such data is handled in accordance with our agreement with your employer, not this Privacy Policy.

HOW WE USE THE INFORMATION WE COLLECT

We and our service providers utilize the information we gather from and about you for various business and operational purposes, including: Providing, improving, enhancing, and promoting our Platform. Analyzing how our Platform is used. Communicating with you, including for marketing and promotional purposes. Gaining insights into potential customers who may be interested in our Platform. Facilitating transactions, deliveries, and payments. Offering customer support, including addressing inquiries, requests, and issues. Conducting research. Identifying and preventing fraudulent activity. Resolving disputes, protecting ourselves and other users, and enforcing any legal terms related to the use of our Platform. Complying with laws, regulations, and other legal processes. Providing data to restaurant vendors on how to optimize their sales on our platform. Inform vendors on analytics regarding their order

ONLINE AND MOBILE APP ADVERTISING

Online Advertising

We may allow third-party advertising services (e.g., ad networks and ad servers such as Google Ads and others) to place relevant and targeted advertisements on our Platform. These ads may be displayed based on factors such as the content you are viewing, the information you provide, your searches, demographic details, and other data we collect. Advertisements may be tailored based on your real-time activity or your activity across different websites and services over time. We may also link cookies to anonymized data based on information you've shared (such as your email address) and share this data in a non-human-readable form with advertising partners to serve you more relevant ads on other websites and mobile apps. We do not control cookies or tracking technologies set by unaffiliated third parties on your device. Please note that opt-out choices apply to each browser and device you use, so you must opt out for each device and browser. These opt-out mechanisms do not apply to ads in mobile apps. Mobile App Advertising

You may encounter personalized ads within mobile apps, including those for Lilac or other related apps. We may use third-party service providers to serve these ads or for mobile app analytics. Each mobile operating system (iOS, Android, and Windows) offers its own guidelines for disabling in-app targeted ads. As we do not control these platform-specific settings, we recommend consulting the support materials or device settings for the relevant operating system to find information on how to opt out of personalized in-app advertising.

Notice Concerning Do Not Track (DNT)

Do Not Track (DNT) is a privacy feature available in certain web browsers, allowing users to request that their online activity not be tracked. While we are committed to providing meaningful choices about the data we collect for third-party purposes, we currently do not recognize or respond to browser-initiated DNT signals. Note that DNT is separate from the legally-required browser-based "preference signal" mentioned in the "Your Rights and Choices" section below.

HOW WE DISCLOSE THE INFORMATION WE COLLECT

Food Providers

We may share your name, contact information, any dietary preferences or restrictions you've provided, and purchase details with food providers you order from, including their affiliates. This information is not governed by this Privacy Policy but by the food provider's own privacy practices, which may allow them to send you marketing or promotional content.

Food Recipients

If you're not the recipient of a food order you've placed, we may share your information with the recipient as part of our communication about the food order.

Your Employer

If you place orders on behalf of your employer and your employer has a Lilac corporate account or has otherwise engaged Lilac to facilitate orders, we will share your information with your employer.

Service Providers

We provide access to or disclose your information to third parties that perform services on our behalf, including billing, payment processing, advertising, web analytics, data storage, customer support, delivery services, security, fraud prevention, and other services.

Affiliates

We may share your information with our affiliates for the purposes outlined in this Privacy Policy.

For Legal Reasons or the Protection of Lilac and Others

We will disclose your information if required by law, legal processes, or if we believe it's necessary to: (i) enforce our Terms of Use, this Privacy Policy, or other contracts with you, including investigating potential violations; (ii) respond to claims that content violates third-party rights; or (iii) protect the rights, property, or personal safety of Lilac, our Platform users, and others. You can unsubscribe from our marketing emails by clicking the unsubscribe link in any email or by updating your preferences in your Profile. Please note that it may take time to process your request, and even if you opt out of marketing emails, you will still receive administrative communications, such as order confirmations and policy updates.

Right to Opt Out of Sales and Targeted Advertising

As mentioned in the "Other Unaffiliated Third Parties" section, we may disclose information to third parties we collaborate with or data cooperatives, which may be considered a "sale" of personal information under applicable law. Additionally, we provide personal information to advertising partners for targeted advertising purposes. If you wish to opt out of such disclosures of your information for "sales" or "sharing" for targeted advertising, please click here. You can also opt out of offline disclosures by clicking here. We do not knowingly sell personal information of minors under 16 years of age without required affirmative authorization. If you have a browser-based opt-out preference enabled, we will honor it in accordance with applicable law.

Disabling Geo-location Tracking

If you've granted us permission to collect your precise GPS location and no longer wish to share it, you can disable location services in your device's settings. Please note that disabling this feature may affect your ability to access certain services or features on the Platform.

Financial Incentives

We may offer rewards or incentives for users who join certain Lilac text message programs. Participation is voluntary, and you can withdraw at any time. If you opt in, you will be informed of any incentives available, and their estimated monetary value will be provided based on various factors like program revenue, expenses, and product improvements. You can opt out of the program at any time by following the instructions in the SMS Terms.

THIRD-PARTY LINKS AND FEATURES

Our Platform may contain links to third-party websites and plug-ins, such as Facebook, LinkedIn, and Twitter. You may also connect to third-party services, like Concur, from our Platform. Please note that we do not control the third parties that operate these websites or services and are not responsible for their content or privacy practices. We encourage you to review their privacy policies before using their websites or services or providing them with your information.

INTERNATIONAL USERS

Please be aware that Lilac operates in the United States and provides the Platform from within the United States. In addition, Lilac may subcontract the processing of your data or disclose it to service providers and trusted business partners in countries other than your country of residence, including the United States, in compliance with applicable laws. These third parties may be involved in various activities such as providing the Platform, processing transactions, and offering support services. By providing us with your information, you consent to any such transfer, storage, or use of your data.

HOW WE PROTECT YOUR INFORMATION
